SPEEDZONE PERFORMANCE LLC. IS ONLY WILLING TO PROVIDE THE SERVICES TO YOU UPON THE CONDITION THAT YOU ACCEPT ALL OF THE TERMS CONTAINED IN THESE TERMS OF SERVICE. PLEASE READ THESE TERMS CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS.

     These Terms of Service, which are incorporated into each Order Form or click-through registration form between a customer and Speedzone Performance LLC  (collectively, with all attachments and incorporated terms, the “Agreement”) constitute a binding agreement between the customer identified on the Order Form or in the click-through registration      (“Customer” or “you”) and Speedzone Performance LLC. (“Speedzone Performance LLC,” “we,” or “us”) regarding the terms under which      Speedzone Performance LLC will provide you with access to its products and related services that allow authorized purchases online and for end buyers to purchase auto-parts from vendors and manufacturers (collectively, the “Services” as defined in section 1 below). The Order Form, all attachments thereto (if any), and this Terms of Service, and all incorporated terms herein, shall be the entire Agreement between the parties in connection with the Services. BY CLICKING ON THE BUTTON MARKED “I ACCEPT” OR BY USING THE SERVICES YOU AGREE TO ABIDE BY AND BE BOUND BY THIS AGREEMENT (“Acceptance”). You agree that your assent, given electronically, will have the same legal effect as if it had been personally signed by you. To the extent permitted by law, this Agreement is intended to supersede any provisions of applicable law, which might otherwise limit its enforce-ability or effect, because it was entered into electronically. By accepting this Agreement, you also represent that you are authorized to accept these Terms on behalf of your company, if applicable.

Your Acceptance or use of the Services also signifies that you have read, understood and agreed to be bound as well by the Website Use Policy and Privacy Policy posted on this Website.

We reserve the right to update or change our Services and this Agreement at any time. Any changes to this Agreement will be posted on this website or otherwise in the Speedzone Performance LLC Services,  and is effective immediate after posting as set forth in section 28 of this Terms of Service. Notwithstanding the foregoing, Speedzone Performance LLC reserves the right to require you to re-accept the updated Agreement before you can continue using the Services. Speedzone Performance LLC may provide you with email notice regarding material changes to this Agreement.

By your Acceptance or use of the Services, you agree that any previous agreements between you and Speedzone Performance LLC will be terminated and superseded by this Agreement. Notwithstanding the foregoing, in the event you negotiate and execute with Speedzone Performance LLC an additional document that expressly amends the terms of this Agreement (an “Amendment”), such Amendment shall supersede and override this Agreement solely to the extent of the changes expressly set forth in the Amendment. In the event of any conflict between the terms in this Agreement and the Amendment, the Amendment will control.


SMS Terms of Service and Opt-in

  1. When opted-in, you will receive text messages (SMS/MMS) to your mobile number. These kinds of messages may include offers, coupons, or other information [add additional description as needed].
  2. You can opt-out of this service at any time. Just text “STOP” to the phone number. After you text “STOP” to us, we will send you an SMS reply to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time or text “START,” and we will start sending SMS messages to you again.
  3. If you are experiencing any issues, you can reply with the keyword HELP. Or, you can get help directly from us [link to your contact page on your website].
  4. Carriers, such as AT&T, are not liable for delayed or undelivered messages.
  5. Message and data rates may apply for any messages sent to you from us and to us from you. You should expect to receive [number] messages per month from us.
